Demandas punitivas. Un estudio cualitativo sobre actitudes frente al delito y al castigo en cuatro ciudades sudamericanas

Resumen

Se exploran las demandas punitivas de residentes de cuatro ciudades sudamericanas a partir de sus orientaciones generales hacia el sistema penal, y específicas hacia el castigo de los supuestos agresores. A partir de grupos focales, se observa una demanda de mayor uso de la fuerza letal policial, de menores garantías procesales para los sospechosos, y de una mayor severidad penitenciaria. En cuanto a la demanda específica ante violaciones reiteradas, se aprueba la cadena perpetua, y de forma muy minoritaria, la pena de muerte, por temor a abusos del poder estatal y a errores, o por su ineficacia preventiva. En cuanto a delitos de drogas, se aprueba la despenalización del consumo de marihuana, pero no de drogas duras por considerarlas precursoras de delitos y violencias; y tampoco se aprueba su venta. En síntesis, si bien hubo expresiones generales y específicas típicamente punitivas, no hubo un “consenso punitivo” entre los participantes.

Abstract: Punitive attitudes of citizens of four South American cities are explored based on their general orientations towards the criminal justice system, and their specific ones towards punishment of offenders. From focus groups analysis, it is noted a demand for greater use of police lethal force, lower procedural guarantees for suspects, and greater prison severity in terms of productivity. Regarding specific attitudes for repeated rapists, life sentence is generally approved, where the death penalty is preferred only by a minority, for fear of misuses and abuses of state power or for its preventive inefficiency. As for drug cases, the decriminalization of the use of marijuana is approved, but not of hard drugs since they are considered triggers of crimes and violences; and their sale is not approved either. In summary, although there were typically punitive general and specific expressions, there was no “punitive consensus” among participants.
