O presente artigo explicitará conceitualmente o problema filosófico da punição.  O texto se desenvolverá em três grandes momentos. O primeiro momento explicitará as raízes pré-filosóficas da punição. O segundo momento reconstruirá as três grandes correntes racionais de justificação da punição: a dissuasão, a retribuição e a reabilitação. O terceiro momento fará um balanço crítico acerca das teorias filosóficas da punição. A hipótese que anima o trabalho é que a punição apesar de possuir um bom argumento na ordem das razões falece de utilidade prática, mostrando-se inefetiva na dissuasão, na retribuição e na reabilitação.
